Acceptance of Terms

You agree to these Terms and Conditions (“Terms and Conditions”) if you are on Destination U, Inc.’s (dba “Road2College,” “we,” “us,” or “our”) websites (Road2College.com, Insights.Road2College.com, or CompareOffers.Road2College.com) or accessing or using our services through any other means, including any framed version of our website or services (collectively, the “Service”). We have the right to modify the terms of this Terms and Conditions at any time and the new agreement shall be effective immediately.

Proper Use

You are only permitted to use the Service for personal, non-commercial uses and you must be at least 13 years old. You are expressly prohibited from scraping our website, copying or modifying the Service, or using the Service for any commercial or unlawful purpose. The Company reserves the right in its sole discretion to refuse, suspend, or terminate the Service to anyone at any time without notice for any reason.

Services

All information provided on this website or through the Service is for informational purposes only. You agree that any reliance on the information on this website or through the Service is at your own risk and that we do not represent that the Service is reliable, accurate, complete, or otherwise valid. Please bring any material on our website that you believe to be inaccurate to our attention by emailing a copy of such material and your rationale to Road2College’s founder, Debbie Schwartz, at debbie@road2college.com.

Your R2C Insights Subscription 

When you sign up to use our Services through our website or separate subscription agreement, you may be assigned or asked to select a subscription plan of either Monthly or Annual(“Plan”). The Plan defines the Services that you are authorized to access throughout the subscribed term (“Subscription Period”), as well as the period in which you will be charged a subscription fee (either monthly or annual). Each Plan may vary in terms of scale, scope, the number and type of authorized users, Subscription Period and pricing (“Fee”).

Unless stated otherwise, a Plan entitles you to use our services during your chosen subscription period (monthly or annual). During the Subscription Period, there is no limit to the number of times a user can access our R2C Insights services.

Because it is possible to take full advantage of our Services in a very short period of time, your monthly or annual Fee is billed up front at your subscription period and paid in full in advance of having access and use of the Services and is nonrefundable. You are responsible for all taxes. You can cancel your subscription at any time but we do not issue refunds or prorations.

Your subscription provides you the right to use the Services in accordance with these Terms.  No other rights in the Services are granted and we retain all ownership rights, including all trademarks, copyrights, trade secrets, proprietary rights and other intellectual property rights, title and interest in the Services. 

Refunds

Unless specifically expressed otherwise, once services or products have been initiated no refunds are provided. 

R2C Insights is a subscription service and can be cancelled anytime during your subscription period. When cancelling a monthly subscription, all future charges associated with future months of your subscription will be cancelled. When cancelling an annual subscription, all future annual renewal charges associated with will be cancelled. You may notify us of your intent to cancel at any time; your cancellation will become effective at the end of your current subscription period billing period. You will not receive a refund; however your subscription access and/or delivery and accompanying subscriber benefits will continue for the remainder of the current subscription plan billing period.

We reserve the right to issue refunds or credits at our sole discretion. If we do issue a refund or credit, we are under no obligation to issue the same or similar refund in the future.

In order to cancel your subscription click on your username in R2C Insights and go to your Profile to find the option to cancel. You can also contact us at support@road2college.com to notify us of your cancellation.

Privacy

Road2College is committed to respecting your privacy and protecting your personally identifiable information. Upon your request, Road2College may share the information you enter on this website with service providers in order to provide you with the information you requested. Road2College account data and certain other information about you and that you enter and/or we collect through your use of this website are subject to the Road2College’s Privacy Policy at https://www.road2college.com/privacy-policy/. You understand that through your use of the Service, including this website, you consent to the collection and use (as set forth in the Road2College’s Privacy Policy) of this information. You are responsible for maintaining the confidentiality of your password and account and are fully responsible for all activities that occur under your password or account. If you believe your password or account has been compromised, please let us know immediately. Please review our Privacy Policy for further information on our data collection and use practices.

Warranty

THE SERVICE IS PROVIDED “AS IS” WITH NO WARRANTY OF ANY KIND AND YOU USE THE SERVICE AT YOUR OWN RISK. ROAD2COLLEGE DOES NOT REPRESENT THAT THE SERVICE IS RELIABLE, ACCURATE, COMPLETE, OR OTHERWISE VALID. ROAD2COLLEGE EXPRESSLY DISCLAIMS ANY WARRANTY, EXPRESS OR IMPLIED, REGARDING THE SERVICE, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. UNDER NO CIRCUMSTANCES WILL ROAD2COLLEGE BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH USE OF THE SERVICE WHETHER OR NOT YOU HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. UNDER NO CIRCUMSTANCES SHALL ROAD2COLLEGE BE LIABLE TO YOU FOR ANY AMOUNT FOR SERVICES RENDERED PURSUANT TO THIS AGREEMENT.

Indemnification

You will indemnify, defend and hold harmless Road2College and its affiliates, partners, officers, directors, employees, and agents from all claims, whether actual or alleged, that arise out of or in connection with a breach of these Terms and Conditions, use of the Service, including any content you submit, post, transmit, modify or otherwise make available through the Service, and/or any violation of law and/or the rights of any third party.

Trademark Information and Intellectual Property

You agree that all of Road2College’s trademarks, trade names, service marks, logos, brand features, and product and Service names are trademarks and the property of Road2College, and that you will not display or use any of the foregoing without Road2College’s prior written approval in each instance. You agree that the Service contain proprietary information protected by applicable intellectual property and other laws in favor of Road2College.

Copyright or Intellectual Property

Road2College respects the intellectual property of others. If you believe that your work has been copied in a way that constitutes copyright infringement, or your intellectual property rights have been violated, please provide us with the following information:

• – a physical signature of the person authorized to act on behalf of the owner of the copyright or other intellectual property right
• – a description of the copyrighted work or other intellectual property that you claim has been infringed or violated
• – a description of where the material that you claim is infringing is located on our website; your address, telephone number, and email address
• – a statement by you that you have a good faith belief that the disputed use is not authorized by the copyright or intellectual property owner, its agent, or the law; and a statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright or intellectual property owner or authorized to act on the copyright or intellectual property owner’s behalf.

Electronic Communication

By using the Service you consent to receive communications from Road2College electronically, including by email and notices on the website. Road2College will communicate with you by email or by posting notices on the Site. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

Links to Other Sites

Road2College may link to third party websites or embed functionality from third party sites. These links and integrations are provided solely as a convenience to you and not as an endorsement by Road2College of the contents on such third-party websites. Road2College is not responsible for such third party content or the collection of your information on linked third-party sites and does not make any representations regarding the content or accuracy of materials on such third party websites. If you decide to access linked third party websites through the Site, you do so at your own risk.

General

These Terms and Conditions and the relationship between you and Road2College are governed by the laws of the Commonwealth of Pennsylvania without regard to its conflict/choice of law provisions. You and Road2College agree to submit to the personal jurisdiction of the federal and state courts located in the Commonwealth of Pennsylvania with respect to any legal proceedings that may arise in connection with this agreement. This agreement constitutes the entire agreement between you and Road2College and governs your use of the Service, superseding any prior agreements between you and Road2College with respect to the Service.
